1. Agreement to Terms

By accessing or using the Marketing Simulation Machine website and application (the "Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms, you may not access the Service.

2. Earnings and Results Disclaimer

Critical Notice

The Marketing Simulation Machine provides mathematical projections, simulations, and models based on user-inputted data, historical benchmarks, and API integrations. THESE SIMULATIONS DO NOT GUARANTEE FUTURE FINANCIAL PERFORMANCE, REVENUE, OR PROFIT.

All business, advertising, and financial decisions carry inherent risk. You acknowledge that any decisions made based on the output of the Service are made strictly at your own risk. We are not liable for any financial losses, unprofitable advertising campaigns, or business failures that occur after using our Service.

3. Subscription and Billing

  • Free Trial: We may offer a 14-day free trial. You must provide a valid payment method to start the trial. You will not be charged if you cancel before the trial period ends.
  • Billing Cycle: Subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan.
  • Cancellations: You may cancel your subscription at any time through your account dashboard. Cancellation will take effect at the end of your current billing cycle.
  • Refunds: All payments are non-refundable. We do not provide prorated refunds for partial months of service.

4. Acceptable Use and Restrictions

You agree not to:

  • Reverse-engineer, decompile, or disassemble the Kaizen Engine, the simulation algorithms, or any part of the Service.
  • Scrape, extract, or systematically download the benchmark database or template library.
  • Use the Service to simulate or promote illegal activities, deceptive business practices, or prohibited advertising categories.
  • Share your account credentials or allow multiple users to access a single-user license.

5. Intellectual Property

The Service and its original content, features, functionality, algorithms, and templates are and will remain the exclusive property of Marketing Simulation Machine and its licensors. The Service is protected by copyright, trademark, and other laws.

6. Limitation of Liability

In no event shall Marketing Simulation Machine, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions.
